Remember to insist on handling these debt purchasing companies in
writing. Do not give out your phone number unless you want more trouble.
The trouble is that in the first instance they will say they are the
bank or credit card company and therefore make you more obliged to comply.
They seek your uncertainty and ambiguity, so they want as much confusion
as they possibly can manage: here is where BCW Group will have the best
result. Because when they get hold of your personal details they will
use it to worry you and even to frighten you. The law is there to prevent
this happening but most people don't know which laws to use and it is

so sometimes such help does not give you the whole picture.

be reassured that many of the things that they are doing to distress
you are illegal or are close to being unlawful. These debt collecting
companies (or DCAs) appear under little obligation, or so it seems,
to do anything about improving their practices unless made to do so
by the Office of Fair Trading.
They will ask you for your mobile phone number (and most people do
nowadays). But you should not give your number to them. Because if they
have it they will bother you wherever you are 24 hours a day if they
want. They will do this even after you ask them not to, so tell them
in writing, and preferably send the letter by registered post so that
you get a signature as proof of safe delivery (although so many operate
from a PO box number so a signature is impossible to get). A few debt
purchasing companies (DPCs) will even contact the people who live next
door to you to ask them about whether they know about your debt. The
worst will tell your children that you are a bad person or say they
will do this, wanting to scare you and thus widen their profit margins.
All these debt collecting firms are driven by greed and their salesmen
know well that they have to reach targets. All these activities are
illegal, yet the law appears indifferent. Dealing with BCW Group can
be very stressful.
It is an option to question the validity of the money owed by making
a sar (Subject Access Request) as a response to BCW Group. The true
owner of the alleged debt (the bank or the dpc) is obliged to give you
a true copy of the original credit agreement if the contract was made
before 6th of April 2007. If they do not do this they are breaking the
law, and the debt is then said to be in dispute. While the alleged debt
is in dispute they must not ask for payment (if they do they are breaking
the law once again) and they are not allowed to sell it on to another
agency (which many do anyway). As long as the alleged debt is in dispute
it is said to be unenforceable, even by a court. There is a series of
letters available that you can use to follow up. If you wish you can
get a lawyer to help you, due to the difficulty of the law at certain
points. There are also legal and paralegal firms offering their services
in this field.
So ask BCW Group Plc

card.
