BCW Group Plc Debt Collectors and
the Truth About Your Debt

Assuming that you are struggling with BCW group debt collectors you'll
be aware of all the ruses they employ to extort money out of you so
that they can make a quick profit. You may already have experienced
bad dealings with them on the phone or by letter. They may phone you
up at odd times and on an unacceptably numerous number of occasions.
They may be sending you official appearing nastily worded letters or
cards threatening to come round and collect the full amount or take
you to court if you cannot pay. Their other tricks might involve attempting
an order for sale charge on your home or make you homeless.
Remember to insist on dealing with these debt collecting agencies
in writing. Don't give out your phone number unless you want more trouble.
The problem is that in the first instance they'll say they are the credit
card company or bank and therefore make you feel inclined to comply.
For them, your uncertainty or even confusion is important, so they like
to create as much confusion as possible: here BCW group debt collectors
will have the most devastating effect. Because when they get hold of
your details they will use it to worry you and even to terrorize you.
The law is there to prevent this kind of thing from happening but the
problem is that most people don't know which laws to use and it is clear
that these debt collecting firms are aware of this. Bodies such as the
Consumer Credit Counselling Service and the CAB (Citizen's Advice Bureau)
give a good free service although all too often they can be overstretched
so sometimes such advice does not provide the whole picture.
It is up to you to call into question the validity of the money owed
or indeed the existence of the account itself by making a Subject Access
Request (or sar) as a reply to BCW group debt collectors. The owner
of the alleged debt (the bank or the debt collecting firm) must send
you a true copy of the original contract if that contract was made before
6th April 2007. If they fail to do this they are breaking the Consumer
Credit Act 1974, and the debt is said to be in dispute. While the alleged
debt is in dispute they must not ask for any money (if they do so they
are breaking the law again) and they cannot sell it on (which many do
at this stage). As long as the debt is in dispute it is unenforceable,
even by a court of law. There's a series of template letters available
for this purpose. You can always get a solicitor to do this for you,
owing to the difficulty of the law at certain points. There are also
specialist legal and paralegal firms offering their services in this
area.
You should make sure you know whether the debt collecting company
has bought the account themselves as a means of turning a profit (in
the role of a debt purchasing company) or whether they are carrying
out work on behalf of another company such as a credit card issuer or
a bank (where they would get a proportion of recovered money). If they
send you a letter of assignment, as required by statute if the debt
has been sold, then you will know the debt collecting firm or DCA owns
the debt and therefore will try to extort as much out of you as they
possibly can. When dealing with BCW group debt collectors bear in mind
that almost every penny the collections agency gets is pure profit because
they purchased the debt wholesale. So they will try to break you any
way they can.

So ask BCW Group Plc Debt Collectors
for a copy of the original contract when you took out your loan or credit
card.
Even better, start
an unenforceable
credit agreement application enquiry. It costs nothing to do this
and you are protected by the consumer credit laws. Click

To find out if you
qualify for an IVA or can benefit from a debt management programme,
try the IVA

laws regarding debt management at all stages. Click
